Terms and Conditions:
In using this website and undertaking 2nd Wife Lifestyle Management's services you are deemed to have read and agreed to the following terms and conditions:
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: "Client", “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. "The Company", “Ourselves”, “We” and "Us", refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing New Zealand Law. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same. The governing law of this agreement shall be the New Zealand law, and the New Zealand courts shall have exclusive jurisdiction.
We are committed to protecting your privacy. We abide by the New Zealand Privacy Act. Authorised employees within The Company on a need to know basis only use any information collected from individual customers. We constantly review our systems and data to ensure the best possible service to our customers.
Clients have the right to request sight of, and copies of any and all records we keep pertaining to themselves, on the proviso that we are given reasonable notice of such a request. Clients are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Clients with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties. We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by this Company will only be in connection with the provision of agreed services and products.
All prices and charges are expressed in New Zealand dollars and are GST inclusive. Services are charged in 30 minute lots or part thereof. Quotes for prices shall remain valid for 28 days only, unless withdrawn or amended earlier. All disbursements or expenses associated with the provision of services are the primary responsibility of the client. For long term or repeat services a monthly invoice will be generated. Where invoices for goods or services remain unpaid for more than 14 days after the due date: 2nd Wife Lifestyle Management may charge 15% per annum on outstanding balances, and may revoke the services granted to the client under this agreement until full payment is made, without extinguishing client liability. In the event of default on payment, the client shall be liable for The Company's costs and expenses (including legal costs on a solicitor/client basis and any debt collection costs) of recovering payment. If payment is not made in accordance with the terms and conditions of this agreement, then The Company reserves the right to withdraw the service immediately.
Services provided will be carried out in accordance with the requirements of the Client identified each time the service is booked, or varied from time to time by arrangement. If the execution or completion of any service is not able to be carried out for reasons beyond the control of the Consultant or the client requires additional work or the services to be varied, then the client shall be charged that which is fair and reasonable for any additional expenses incurred by 2nd Wife Lifestyle Management over and above the normal charges for the service.
Minimum 24 hours notice of cancellation required. Notification for instance, in person, via email, mobile phone ‘text message’ and/or fax, or any other means will be accepted.
Termination of Agreements and Refunds Policy:
Both the Client and ourselves have the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. No refunds shall be offered, where a Service is deemed to have begun and is, for all intents and purposes, underway. Any monies that have been paid to us which constitute payment in respect of the provision of unused Services, shall be refunded.
Health and Safety:
The Client agrees to be responsible for ensuring that the work environment of the Consultant is compliant with the requirements of the Health and Safety in Employment Act 1992
The insurance taken out by 2nd Wife Lifestyle Management only covers the Consultant while they are working on an assignment from 2nd Wife Lifestyle Management and for the duration of that assignment. The responsibility of ensuring property and contents are adequately insured whilst The Company provides its services is the responsibility of the Client. We will take the best of care, however, we cannot accept liability to the Client for loss or damage to property or contents, unless held legally liable. Where the Client requires a Consultant to drive their car, responsibility for ensuring appropriate insurance cover rests with the Client. The Company will not be held responsible for any accident or damage to the Client's vehicle, unless held legally liable. The Client acknowledges that even with the best of care, accidents and illness can occur with pets, and therefore, releases The Company from liability should this occur whilst the pet is in The Company's care.
The Client will provide all food and other supplies necessary for the full care of their pet. Any food, pet supplies or veterinary expenses incurred by The Company during the course of the assignment must be reimbursed by the Client, including services and products/medications from a vet other than the Client's usual vet.
The Company reserves the right to amend these Terms and Conditions without notification to the Client.
The Company and the Client agree to take all reasonable steps to resolve by negotiation any dispute that may arise in connection with this agreement. Any dispute that cannot be resolved by negotiation shall be referred to arbitration in accordance with the Arbitration Act 1996. The parties agree to pay their respective costs.
